California High Court Overturns Gay Marriage Ban

California joins Massachusetts as the second state to legalize gay marriage following a decision by the state’s highest court. Ruling 4-3, the court found marriage to be a “fundamental constitutional right,” and to deny that right to same-sex couples would require a compelling government interest. The high court determined the state had failed to show such an interest. Unlike in Massachusetts, nothing prevents out-of-state same-sex couples from coming to California to get married.

This historic ruling is hot off the press and some details have not been ironed out as of this date. At this point, outstanding issues appear to be:

  • Marriage license forms must be revised by the state before same-sex couples can apply for a license. It is anticipated that form revision will take at least 30-days.
  • It doesn’t appear that the ruling is “transferable.” This means that the marriage will not be recognized by all of the other states in the nation.
  • There will be an attempt by gay marriage opponents to place a ballot measure on the November election. If actually placed, the measure will seek to ban gay marriage within the state constitution. We have heard (through the grapevine) that there may be an attempt to “stay” the high court ruling until the ballot measure issue is resolved.
